Terms of Service

These Terms of Service ("Terms") are a legal agreement between you ("you") and Claim Atlas LLC, a Tennessee limited liability company ("Claim Atlas", "we", "us", or "our"). By creating a Claim Atlas account or using the service, you agree to these Terms. We've tried to keep them in plain English — if anything is unclear, email us.

The service

Claim Atlas provides hosted claims management software for independent adjusters, carrier teams, and related users. We make the software available on a subscription basis.

Your account

You are responsible for keeping your credentials secure and for all actions taken under your account. You represent that you are authorized to accept these Terms on behalf of, and to register, the company name you provide.

Acceptable use

Don't use the service to break the law, infringe others' rights, upload malware, or interfere with other customers. We may suspend or terminate accounts that do.

Billing

Paid plans auto-renew monthly or annually. You can cancel at any time from the billing portal. Refunds are handled case by case within the first 30 days. Prices may change with 30 days notice.

Your data

Your data is yours. We act as a custodian of it in order to provide the service. You can export it at any time. On cancellation, we retain it for 30 days, then delete it. You are responsible for the data and content you upload and for having the rights and authorization to store and share it through the service.

Not professional advice

Claim Atlas is a software tool. It does not provide insurance, legal, financial, or other professional advice, and it is not a substitute for your own professional judgment. You are solely responsible for your claim handling, valuations, estimates, determinations, and any decisions you make using the service, and for complying with the laws, licensing requirements, and carrier or client obligations that apply to your work.

Warranties and disclaimers

The service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, Claim Atlas LLC disclaims all implied warranties, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the service will be uninterrupted, secure, error-free, or that it will meet your requirements. You are responsible for reviewing the service's outputs before relying on them and for keeping your own copies of data that is critical to you.

Limitation of liability

To the fullest extent permitted by law, Claim Atlas LLC and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business interruption, arising out of or relating to your use of (or inability to use) the service, even if we have been advised of the possibility of such damages. Our total liability for all claims relating to the service will not exceed the amount you paid us in the 12 months before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

Indemnification

You agree to indemnify and hold harmless Claim Atlas LLC and its owners, employees, and contractors from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the service; (b) the data or content you upload — including any claim that it infringes or violates the rights of a third party, or that you were not authorized to store or share it; or (c) your violation of these Terms or of any applicable law.

Changes to these terms

We may update these Terms from time to time. If we make a material change, we'll let you know by email or in the app. Continuing to use the service after a change takes effect means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the State of Tennessee, United States, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the service will be brought exclusively in the state or federal courts located in Tennessee, and you consent to their jurisdiction.
